Terms and Conditions of Sale
Definitions:
The present General Terms and Conditions of Sale (hereinafter referred to as the "GTCS") are those of Le Chantry (hereinafter referred to as the "Company"), registered in the Bordeaux Trade and Companies Register under number B 378 803 621, whose head office is located at 153 Rue Georges Bonnac in Bordeaux (telephone 05 64 37 64 00).
The Company is the owner and publisher of the website https://marty-hotel.com. The site is hosted by the company OVH, registered in the Lille Metropole Trade and Companies Register No. 424 761 419, whose head office is located at 2, rue Kellermann 59100 Roubaix (telephone 09 72 10 10 07).
The director of the publication is Mr Sébastien Meslin.
The site offers the Customer (hereinafter the Customer) the possibility to book and pay for rooms at Marty Hotel Bordeaux (hereinafter the Services).
The official language of the site is French, an English version is also available.
- Application of the T&Cs:
The purpose of these Terms and Conditions is to define the terms and conditions for the marketing of the Hotel's Services and apply to any order (hereinafter referred to as the Order) placed on the Website by the Client.
The validation of the Order by the Client shall constitute acceptance of the GTC. The Client declares that he/she has received all the information required to place the Order on the Company's Web site.
- Ordering Services on the site:
The Client books the Service(s) that suits him/her on the site. The Services are described and presented in a precise manner on the Company's website. At any time, the Customer can find out the amount of his Order. The Client is responsible for his choice of Services.
The Customer may modify his or her Order until it has been validated. The Order summary lists the Services ordered as well as their prices, including any additional amounts (tourist tax).
At the end of the Order, the Customer confirms acceptance by checking the box to validate the GTC and then clicking on 'Confirm my reservation'. Some 'No change, no cancellation' offers require the explicit acknowledgement of the obligation to pay for the Order online.
Once the Order has been validated, the Company will send an e-mail confirmation to the Client containing the details of the reservation.
- Terms of payment for the online order
The prices of the different Services are mentioned in the descriptions, and are in Euros, all taxes included. Unless otherwise stated or special offers, additional services are not included in the price (breakfast, etc. ...)
In the case of an online payment, the Site uses a secure transaction system via Hilton. This system guarantees the confidentiality of the Customer's bank details.
The data is thus totally encrypted and protected. They are not stored by the Company.
The Company reserves the right to suspend or cancel any Order in the event of non-payment, fraud or attempted fraud.

- Right of withdrawal:
In accordance with article L 221-28 of the French Consumer Code, the Customer acknowledges that the right of withdrawal is not applicable to the provision of hosting services. As such, he expressly waives any right of withdrawal by accepting these GTC.
- Processing of personal data
In the course of its business, the Company is required to process certain personal data of its Customers. The Company attaches great importance to the respect of privacy and takes all necessary measures to ensure the confidentiality and security of the personal data of its Clients.
The Company collects personal data, including the following information
- Email address
- First and last name
- Mailing address
- Phone numbers
- Bank details (cards)
The Customer consents to the processing and analysis of this data for the following purposes:
- Site management
- Order management
- Payment of orders
- Response to questions or complaints
- Management and sending of the newsletter
- Development of statistics
- Management of requests for access, rectification and opposition rights
- Management of unpaid bills and litigation
The personal data of the Customers are kept for the time strictly necessary for the above purposes within the limit of three years after the collection or the last contact with the Customer.
The Company may be required to communicate the personal data of the Clients in order to cooperate with administrative and judicial authorities.
Pursuant to Decree 2011-219 of February 25, 2011 relating to the conservation and communication of data allowing the identification of any person having contributed to the creation of a content put on line, the Customer is informed that the host of the site has the obligation to keep for a period of one year as from the day of the creation of the contents, namely :
- The identifier of the connection at the origin of the communication
- The identifier assigned by the information system to the content concerned
- Protocols used to connect to the service
- The nature of the operation
- Dates and time of the operation
- The identifier used by the author of the operation
The Company collects the IP address of each computer used by the Clients in order to analyze the traffic of the site and to control that it does not proceed to acts that could harm the interests of the Company.
In accordance with the French Data Protection Act of January 6, 1978, and any regulation amending or replacing it, Customers have the right to access, rectify, delete, and oppose the processing of their data collected and processed by the Company, by contacting the Company directly at the following email address hello@marty-hotel.com
In the context of the use of the site by the Customers, the Company is likely to use cookies. An alert message asks each person visiting the site, beforehand, if they wish to accept cookies. These cookies do not contain any confidential information about the Clients.
- Applicable law and jurisdiction
These GTC are governed and interpreted in accordance with French law. In the event of a dispute over the interpretation or execution of these GTC, the Client and the Company shall together seek an amicable solution to the dispute.
If the parties fail to reach a settlement within 30 days, they may bring the matter before the court at the Company's headquarters.
